Terms of Service
Last updated: 28 November 2025
These Terms of Service ("Terms") govern use of aiawyer.com and the Alawyer platform (the "Service"), operated by Alawyer GmbH ("the Company", "we", "us", or "our") at Herrengasse 28, 2nd Floor, 8010 Graz, Austria. By accessing or using the Service, you accept these Terms. Do not use the Service if you disagree.
The Service is designed for use by licensed lawyers, legal professionals, and legal teams operating within the professional standards of their respective bar associations and chambers. Nothing in these Terms limits the statutory rights of consumers (natural persons acting outside any trade, business, craft, or profession) under applicable mandatory law.
1. The Service
Alawyer offers AI-assisted contract clause extraction, risk identification, and case law research across German-speaking jurisdictions, including Bundesgerichtshof (BGH), Oberster Gerichtshof (OGH), and Oberlandesgericht-level courts. The Service relies on regularly updated machine-learning models, so results may vary between sessions.
2. Professional Responsibility
Service outputs, including clause-analysis reports and case-law results, are research aids for review by a licensed legal professional. The Company does not represent that any output is legally accurate, current, or appropriate for a particular matter. You and your organisation retain sole professional responsibility for legal conclusions, client advice, and documents filed or executed using Service-assisted work. Alawyer's use does not relieve you of professional duties, including care and confidentiality obligations under applicable bar rules, the Austrian Rechtsanwaltsordnung (RAO), the German Bundesrechtsanwaltsordnung (BRAO), or equivalent professional regulation.
3. Eligibility and Account
- Users must be 18 or older to use the Service.
- You must submit accurate registration details and keep your account credentials confidential.
- You are liable for every activity conducted through your account.
- Do not use the Service unlawfully, disrupt its operation, or seek unauthorised access.
- You may not copy, scrape, or reverse-engineer the Service unless mandatory law allows.
4. Intellectual Property
The Company or its licensors own the Service, including its software, models, interface elements, and documentation. Austrian, EU, and international intellectual-property law protects it. During your subscription term, you receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended professional purpose.
5. Your Documents and Content
You keep ownership of documents and text submitted to the Service. Submission grants the Company a limited, non-exclusive licence to process that content only to provide the Service, subject to the data-handling commitments in our Privacy Policy. Uploaded documents will not be used to train AI models or disclosed to third parties, except as needed to deliver the Service under GDPR-compliant data-processing agreements.
You represent and warrant that you may lawfully submit each uploaded document, including with any required client consent or professional-privilege authority.
6. Subscriptions and Payment
Full access to the Service requires a paid subscription. Subscription charges are stated in EUR at the rates on our pricing page. Each subscription renews automatically at the close of its billing period unless cancelled before renewal. Cancellation is available in your account settings and takes effect when the current billing period ends.
Subscription fees may be changed on at least 30 days' notice. Using the Service after the change takes effect means you accept the revised fees.
7. Right of Withdrawal (Consumer Contracts)
Where you enter into a paid contract with the Company as a consumer at distance, you have the right to withdraw within 14 days under the EU Consumer Rights Directive without giving any reason. To exercise the right, send a clear statement of withdrawal to [email protected]. We will refund all payments received within 14 days of receiving your withdrawal notice. If you have requested commencement of the Service within the withdrawal period and then exercise your right of withdrawal, you may owe a proportionate charge for the service provided up to the point of withdrawal.
8. Disclaimers and Statutory Guarantees
The Service is provided on an "as is" and "as available" basis. The Company does not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate, complete, or up-to-date with the latest judicial decisions. Case law databases have inherent gaps; legal research outputs must be independently verified before reliance. Nothing in these Terms excludes or limits the Company's liability for: (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under mandatory law. Statutory guarantees applicable to consumers under EU and Austrian law are not affected.
9. Limitation of Liability
To the extent permitted by applicable law, the Company's total aggregate liability to you for any claim arising from or in connection with the Service will not exceed the total fees you paid to the Company in the three months preceding the event giving rise to the claim, or EUR 500, whichever is greater. This limitation does not apply to liability that cannot be limited under mandatory law (see Section 8).
10. Termination
Either party may terminate a subscription at any time, subject to Section 6 billing periods. The Company may immediately suspend or end access for a material breach, including unlawful use or harmful, or potentially harmful, misuse of AI outputs toward third parties. Sections 2, 4, 5, 8, 9, 11, and 12 survive termination.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Austria, excluding its conflict-of-laws rules.
The courts of Graz, Austria have exclusive jurisdiction over any dispute arising from or in connection with these Terms, subject to mandatory consumer-protection rules of your country of residence that may give you additional forum rights (see Article 17-19 of Regulation (EU) 1215/2012). If you are a consumer, you may also bring proceedings before the courts of your country of residence, and the Company may sue you only in those courts.
The European Commission provides an online dispute resolution platform for consumers at ec.europa.eu/consumers/odr. The Company does not commit to using ODR procedures but will cooperate where required by applicable law.
12. Changes to These Terms
These Terms may be updated. For material changes, the new "Last updated" date will indicate the revision; subscribers will also receive email notice at their registered address at least 14 days before the change takes effect. Continued Service use after that date constitutes acceptance.
